Terms of Service

Welcome to Image Brawl! These Terms of Service ("Terms") govern your access to and use of the Image Brawl website, applications, APIs, and services (collectively, the "Service"). Please read these Terms carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Account Registration

To access certain features of the Service, such as creating battles or managing your profile, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2. Battle Creation and Content

Users can create image "battles" by uploading images, using our AI image generation feature (powered by OpenAI), or searching for images via Google Search. You are responsible for the content you upload or generate, including ensuring you have the necessary rights or permissions.

You retain ownership of the content you submit, but you grant Image Brawl a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content solely for the purpose of operating and providing the Service.

AI-generated images are subject to the terms of the underlying AI provider (e.g., OpenAI). Use of the AI generation feature may consume credits from your account.

3. Voting and Ranking

Users can participate in battles by voting on image pairs. We employ measures to ensure fair voting, including limiting votes to one set per user per battle (tracked via account or IP address/browser identifiers for guest users).

Image rankings are determined by algorithms (QuickRank, TrueSkill, Bayesian) selected by the battle creator. Leaderboard visibility (Real-time, Post-only, Hidden) is also determined by the creator.

4. User Conduct

You agree not to misuse the Service or help anyone else do so. This includes, but is not limited to:

  • Uploading or generating illegal, harmful, infringing, or offensive content.
  • Attempting to manipulate votes or rankings.
  • Interfering with the proper functioning of the Service.
  • Attempting to access accounts or data that do not belong to you.

5. Credit System

The Service utilizes a credit system. Free users receive an initial credit allocation. Credits may be consumed for certain actions, primarily AI image generation. Additional credits may be earned through referrals or potentially purchased (purchase feature not yet implemented). Running out of credits may limit your ability to use certain features.

6. Referral System

Users may receive a unique referral code. If a new user signs up using your code, you may be awarded bonus credits. Abuse of the referral system is prohibited.

7. Data Storage

Battle data, image references (URLs or storage paths), votes, and user profile information (including credits and referral data) are stored using Supabase database and storage solutions.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. ImageBrawl disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. ImageBrawl will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

10. Governing Law

These Terms shall be governed by the laws of Delaware, without regard to its conflict of law principles.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of changes by posting the new Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
